2. Eligibility to Use the Services

You may only use our Services if:

 

  • You are at least 18 years old or the legal age of majority in your country.
  • You have full legal capacity to enter into contracts.
  • You agree to provide accurate, complete, and truthful information at all times.

 

3. Description of Services

Our Services include:
  • Evaluating and submitting compensation claims to airlines on your behalf.
  • Managing communication and negotiations with airlines and relevant authorities.
  • Initiating legal proceedings if necessary to obtain compensation.
  • Receiving compensation funds on your behalf and transferring them to you after deductions.

 

4. “No Win, No Fee” Policy

We operate on a No Win, No Fee basis. This means:
  • You owe us nothing unless your claim is successful.
  • Our service fee is a percentage of the awarded compensation:
    • 25% for standard claims
    • 33% if the client already contacted the airline or another service
    • Up to 50% if legal escalation is required
  • Any court or administrative costs, if applicable, are separately charged.

 

5. Client Obligations

By using our Services, you agree to:
  • Provide all necessary documentation and correct personal information.
  • Not pursue the same claim through another service provider or directly with the airline.
  • Immediately notify us of any airline communication regarding your case.
  • Refrain from any action that may interfere with our ability to handle your claim effectively.

 

6. Authorization

By using our Services, you authorize Payback Claim LTD to:
  • Represent you in compensation matters.
  • Access, use, and submit relevant documents.
  • Communicate and negotiate with the airline or relevant authorities.
  • Receive compensation funds on your behalf.

 

7. Termination & Withdrawal

You have the right to withdraw from the service:
  • Within 14 days of signing the Terms & Conditions without penalty, provided no claim has been submitted.
  • After this period or once the claim has begun, withdrawal may incur a fee reflecting the work already done.
  • If legal action has already been filed, the full service fee may apply.

 

We may terminate your use of the Services if:
  • You violate these Terms.
  • You submit fraudulent or false information.
  • You engage with other claim services for the same case.

 

8. Compensation Payment

If compensation is successfully recovered:
  • We will deduct the agreed service fee and applicable costs.
  • The remaining balance will be transferred to your provided bank account within 7 business days.

 

9. Intellectual Property

All content on our website (text, graphics, branding, software, etc.) is the intellectual property of Payback Claim LTD or our licensors. You may not reproduce, distribute, or exploit any part of our Services without our written permission.

 

10. Limitation of Liability

We are not liable for:
  • Unsuccessful claims due to reasons beyond our control.
  • Incorrect or incomplete information provided by the client.
  • Delays caused by airlines or third-party organizations.
  • Indirect or incidental damages arising from service use.

 

Our total liability is limited to the amount of the service fee you paid (if any).

 

11. Force Majeure

We are not responsible for any delays or failures in performance caused by events outside our reasonable control, including but not limited to natural disasters, government actions, system failures, or legal restrictions.

 

12. Data Protection

We handle your personal data in accordance with our Privacy Policy and applicable data protection laws (including the UK GDPR). By using our Services, you agree to our use of your data as described in the Privacy Policy.

 

13. Changes to the Terms

We may revise these Terms from time to time. Updates will be posted on our website, and material changes will be communicated by email. Continued use of our Services after updates constitutes acceptance of the new Terms.
 

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be exclusively resolved in the courts located in London, United Kingdom.
